Buying off-plan, purchasing a villa before it is finished, often straight from the developer's drawings, is increasingly common on Koh Samui, and for good reason. You typically pay less than for a completed home, you can spread payment across the build, and you get first pick of the best plots and a brand-new property tailored to current tastes. But off-plan also carries the most risk of any way to buy, because you are paying for something that does not yet exist. This guide lays out the genuine upside and the real risks, so you can decide with clear eyes.



Why Do People Buy Off-Plan?

The appeal is straightforward. Off-plan prices are usually lower than completed equivalents, sometimes significantly, because the developer wants early sales to fund construction. Payment is staged across the build rather than due all at once, which eases cash flow. You get the pick of the development, the best plots, views, and orientations go first. And you receive a brand-new villa with current design, new fittings, and warranties, rather than someone else's wear and tear. For investors, buying early in a good development can mean the property is already worth more by completion.



What Are the Real Risks?

Here is the honest part. Off-plan concentrates risk in ways a completed purchase does not.

The biggest is completion risk, the possibility that the project is delayed, changed, or in the worst case never finished. Construction timelines in Thailand can slip, and a developer that runs out of funding mid-build leaves buyers exposed. Second is the gap between render and reality: the finished villa may not match the glossy visuals in size, finish quality, or feel. Third is developer risk, not every developer has the track record or the financial strength to deliver what they promise. And fourth, the market can move during the build period, so the value at completion is not guaranteed to be what you hoped.

None of these means avoid off-plan. They mean choose the developer and the contract carefully.



How Do You Protect Yourself?

The single most important factor is the developer's track record. Look at what they have actually completed on the island, visit those finished projects, and talk to existing owners if you can. A developer with several delivered developments and satisfied buyers is a very different proposition from a first-timer with a beautiful brochure.

Next, scrutinise the payment structure. A well-structured off-plan deal ties payments to genuine construction milestones, a deposit, then staged payments as the foundation, structure, roof, and finishes are completed, with a meaningful final payment on handover. Be wary of any structure that front-loads too much of your money before the building physically progresses. Where possible, escrow or staged-on-completion arrangements protect you far better than large upfront sums.

Then get the contract reviewed by an independent Thai property lawyer, not the developer's. It should specify the completion date and what happens if it slips, the exact specifications and finishes, penalty clauses for delay, and the ownership structure (whether the finished villa is sold freehold, leasehold, or with a later conversion option). On Koh Samui, following the 2024 to 2026 crackdown on company structures, many off-plan villas are now sold as registered leasehold or genuine freehold, sometimes with an option to convert, so be clear which you are getting.



What Does the Ownership Structure Look Like?

This matters more on Samui than in a condo market. Because most off-plan here is villas (and foreigners cannot own land), the structure will typically be a registered long lease on the land plus ownership of the building, or a freehold arrangement where the development is set up to allow it. Some newer developments, designed after the nominee crackdown, deliberately offer clean leasehold and freehold options rather than relying on company holding structures. Understand exactly what you will hold at completion, and how secure it is, before you pay a deposit.



Is Off-Plan Right for You?

Off-plan suits buyers who are comfortable with some risk in exchange for better pricing and a brand-new, well-located property, and who are buying from a credible developer on a sensibly staged contract. It suits investors who can wait out the build period for a potential value uplift. It does not suit anyone who needs certainty of timing, cannot tolerate the possibility of delay, or is being asked to pay most of the price upfront to an unproven developer. If a deal feels rushed or the payment terms feel front-loaded, that is your cue to slow down.
